OVERVIEW

Welcome to Lisa Hart. The terms “we”, “us” and “our” refer to Lisa Hart.

Lisa Hart operates this website, including all related information, content, features, tools, products and services, to provide you with our products and services (the “Services”).

Lisa Hart is powered by Shopify, which enables us to provide the Services to you.

These Terms and Conditions, together with any policies referenced in them, describe your rights and responsibilities when you use the Services.

Please read these Terms carefully, as they contain important information about your legal rights, including provisions relating to intellectual property, warranties and liability.

By visiting, interacting with or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms or our Privacy Policy, you should not use or access the Services.

SECTION 1 – ACCESS AND ACCOUNT

By using the Services, you confirm that you are legally capable of entering into a contract under the laws that apply to you.

Where you purchase products or services on behalf of a child or another person, you are responsible for ensuring that you have the appropriate authority to do so.

To use certain parts of the Services or make a purchase, you may be asked to provide information such as your email address, billing information or delivery information.

You agree that all information you provide is accurate, current and complete and that you have the necessary rights to provide it.

Where an account is created, you are responsible for keeping your account credentials secure and for activity carried out through your account.

SECTION 2 – OUR PRODUCTS AND SERVICES

We may offer a range of physical products, digital products and services through the website.

Physical products may include printed workbooks, creative resources and other tangible products. Where a physical product is made to order or personalised, this will be stated on the relevant product page.

Digital products may include PDF workbooks, downloadable guides, templates, resources and other digital content. Digital products are supplied in the format described on the relevant product page.

Services may include creative support, mentoring, guidance, workshops or other services offered from time to time. The specific nature of each service will be described on the relevant service page.

We make reasonable efforts to ensure that descriptions, images and information relating to our products and services are accurate.

Colours and the appearance of physical products may vary depending on your device, screen settings and other technical factors.

Product and service descriptions, images, availability and pricing may be changed from time to time.

We reserve the right to discontinue products or services and, where appropriate, to limit quantities or availability.

For digital products, it is your responsibility to ensure that your device and software are capable of opening and using the files provided.

For physical products, any information about production, dispatch or delivery will be provided on the relevant product page or during the ordering process.

SECTION 3 – ORDERS AND BOOKINGS

When you place an order for a physical product, digital product or service, you are making an offer to purchase the item or service selected.

Your order or booking is accepted when we confirm acceptance and have received your payment.

We reserve the right to decline or cancel an order or booking where there is a genuine reason to do so, including suspected fraudulent or unauthorised activity, an obvious pricing or product error, or circumstances where we are unable to provide the product or service ordered.

If we cancel an order or booking after payment has been taken, we will arrange an appropriate refund.

Please review your order or booking carefully before completing your purchase.

Your purchases are subject to our Returns & Refunds Policy and, where applicable, any additional terms provided for a particular service.

Unless otherwise agreed, products purchased through the website are for your personal or household use and not for commercial resale.

SECTION 4 – PRICES AND BILLING

Prices are displayed in pounds sterling (£).

The price charged will be the price shown at the time you place your order and will be set out in your order confirmation.

Prices may be changed at any time, but changes will not affect orders that have already been placed and paid for.

Where applicable, prices will include VAT.

You agree to provide accurate and complete payment and contact information and to update this information where necessary so that we can process your order and contact you about it.

Payment is due in full at the time of purchase.

Payments are processed through our payment provider. We do not store your full payment card details.

SECTION 5 – SHIPPING AND DELIVERY

Where physical products are offered, shipping and delivery are subject to our Shipping Policy, which provides further information about available delivery destinations, dispatch times, delivery estimates, shipping costs and our delivery arrangements.

We will make reasonable efforts to dispatch and deliver physical products within the timeframes stated in our Shipping Policy or provided during the ordering process.

Delivery times are estimates and may be affected by circumstances outside our reasonable control, including postal or courier delays, severe weather, strikes, customs processing or other unforeseen events.

Nothing in this section or our Shipping Policy affects or limits your statutory rights under applicable consumer law.

SECTION 6 – INTELLECTUAL PROPERTY

Unless otherwise stated, all content, designs, text, graphics, workbooks, guides, templates, resources, images, branding and other materials provided through the Services are owned by Lisa Hart or are used with permission and are protected by copyright and other intellectual property laws.

Our products are licensed for personal, non-commercial use only unless expressly stated otherwise.

You may download and print purchased PDF workbooks or other digital products for your own personal use.

You must not share, sell, resell, redistribute, publish, upload, reproduce, commercially exploit or otherwise make our products or materials available to others without our prior written permission.

You must not use our products or materials to create products or services for sale or distribution to others.

You must not remove copyright, branding or other ownership notices from our materials.

All rights not expressly granted to you are reserved by Lisa Hart.

SECTION 7 – OPTIONAL TOOLS AND THIRD-PARTY SERVICES

We may provide access to tools, features or services provided by third parties as part of the Services.

These third-party services may operate independently from us and may be subject to their own terms and conditions.

Where third-party tools are made available through our Services, they are provided on an “as is” and “as available” basis to the extent permitted by law.

You are responsible for reviewing and accepting any terms that apply to your use of third-party services.

We may introduce new features, tools or resources in the future, which will also be subject to these Terms.

SECTION 8 – THIRD-PARTY LINKS

The Services may contain links to websites or services operated by third parties.

These websites are independent from us and we are not responsible for their content, accuracy, availability, security or practices.

If you choose to access a third-party website or service, you do so at your own risk and may be subject to that third party's terms and privacy policy.

Complaints or questions about third-party products or services should generally be directed to the relevant third party.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

Lisa Hart is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Lisa Hart.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Lisa Hart, including any injury, damage, or loss resulting from purchased products and services.

You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Lisa Hart.

SECTION 10 – PRIVACY POLICY

Personal information collected through the Services is handled in accordance with our Privacy Policy.

You can read our Privacy Policy on this website.

Because the Services are hosted by Shopify, Shopify may collect and process certain personal information relating to your access to and use of the Services in order to provide and improve the Services.

Information you submit through the Services may be transmitted to and shared with Shopify and other service providers where necessary to provide the Services.

Please refer to our Privacy Policy for further information about how personal information is collected, used and stored.

SECTION 11 – FEEDBACK AND REVIEWS

If you voluntarily submit feedback, reviews, testimonials, suggestions or other content to us, you give us permission to use that content for the purposes of operating, improving and promoting our Services, subject to applicable law.

You confirm that you have the necessary rights to provide the content and that it does not infringe the rights of another person.

We may remove or decline to publish content that we reasonably consider unlawful, offensive, misleading, defamatory or otherwise inappropriate.

We are not obliged to publish, maintain or respond to feedback or reviews.

SECTION 12 – ERRORS, INACCURACIES AND OMISSIONS

Occasionally information on the Services may contain typographical errors, inaccuracies or omissions, including in relation to product descriptions, pricing, promotions, availability, shipping charges or delivery information.

We reserve the right to correct errors or inaccuracies and to update information where appropriate.

If an error affects an order you have placed, we will take reasonable steps to notify you and, where required by law, give you the appropriate option to cancel or receive a refund.

SECTION 13 – PROHIBITED USES

You may use the Services for lawful purposes only.

You must not:

use the Services for any unlawful or fraudulent purpose; infringe our intellectual property rights or those of others; transmit viruses, malware or other harmful code; attempt to gain unauthorised access to the Services or related systems; interfere with the security or operation of the Services; impersonate another person or provide deliberately false information; copy, reproduce, extract, scrape, resell or commercially exploit our Services or content without permission; collect or track the personal information of others without lawful authority; use automated systems to access the Services in a way that places an unreasonable burden on the Services or circumvents technical restrictions; or use the Services in any way that could harm us, Shopify, our service providers or other users.

We reserve the right to suspend or terminate access where we reasonably believe that these Terms have been breached.

SECTION 14 – CREATIVE SUPPORT AND MENTORING

Where creative support, mentoring or other services are offered, these are provided for educational, informational and creative development purposes.

While we aim to provide useful guidance and support, we do not guarantee any particular outcome, result, income, qualification, career progression, business result or other specific outcome.

You remain responsible for your own decisions, actions and implementation.

Our support and mentoring does not constitute professional, legal, financial, therapeutic or medical advice.

SECTION 15 – TERMINATION

We may suspend or terminate your access to the Services where we reasonably believe you have breached these Terms or where necessary to protect the Services, our business or other users.

You remain responsible for any amounts due up to the date of termination.

Provisions relating to intellectual property, privacy, liability, governing law and any other provisions which by their nature should continue will remain in effect following termination.

SECTION 16 – DISCLAIMER OF WARRANTIES

We aim to ensure that our Services are reliable and useful, but we cannot guarantee that the website or Services will always be available, uninterrupted, secure or free from errors.

Information provided through the Services is intended for general informational and educational purposes.

To the fullest extent permitted by law, we do not guarantee that the Services will meet every individual requirement or produce a particular result.

Nothing in these Terms excludes or limits any warranty, right or protection that cannot lawfully be excluded or limited under applicable law.

SECTION 17 – LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights.

Subject to the above, to the fullest extent permitted by law, Lisa Hart will not be liable for losses that were not reasonably foreseeable at the time the relevant contract was formed.

We are not responsible for losses caused by events outside our reasonable control or by your misuse of the Services.

Nothing in these Terms affects any rights or remedies you have under applicable consumer law.

SECTION 18 – INDEMNIFICATION

To the extent permitted by law, you agree to be responsible for losses or claims reasonably arising from your deliberate misuse of the Services, your breach of these Terms, or your infringement of another person's rights.

This section does not affect any rights you have as a consumer under applicable law.

SECTION 19 – SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be removed or limited to the extent necessary, without affecting the validity of the remaining provisions.

SECTION 20 – WAIVER AND ENTIRE AGREEMENT

If we do not immediately enforce a right under these Terms, this does not mean that we have waived that right.

These Terms, together with our Privacy Policy, Returns & Refunds Policy and any other policies expressly referred to in them, form the agreement governing your use of the Services and purchases made through the website.

SECTION 21 – ASSIGNMENT

You may not transfer or assign your rights or obligations under these Terms without our prior written consent.

We may transfer or assign our rights and obligations where reasonably necessary to operate or restructure our business, subject to applicable law.

SECTION 22 – GOVERNING LAW

These Terms and Conditions are governed by the laws of Scotland.

If you are a consumer, you will also retain any mandatory rights and protections available to you under the laws that apply to you.

Any disputes will be subject to the jurisdiction of the Scottish courts, except where applicable consumer law gives you the right to bring proceedings elsewhere.

SECTION 23 – HEADINGS

The headings used in these Terms are included for convenience only and do not affect their interpretation.

SECTION 24 – CHANGES TO THESE TERMS

You can review the most current version of these Terms at any time on this page.

We may update, change or replace these Terms by posting an updated version on our website.
